These Terms and Conditions (“Terms”) govern your access to and use of PropVidsAi, including all related services, software, websites, applications, and content (collectively, the “Service”).

By accessing or using PropVidsAi, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. Company Information & Ownership

PropVidsAi is a proprietary platform owned by OneToBeam PTE Ltd, Singapore.

For operations in India, PropVidsAi is operated under license by Armonia Technology Services Private Limited, India, which is authorized to market, sell, support, and operate the Service within India.

All intellectual property rights in the Service remain with OneToBeam PTE Ltd unless explicitly stated otherwise.

2. Eligibility

• You must be at least 18 years old and legally capable of entering into binding contracts to use this Service.
• By using PropVidsAi, you represent that you are using the Service for lawful business or personal purposes.

3. Description of Service

PropVidsAi enables users to:

• Upload property images
• Arrange images in a chosen sequence
• Generate AI-assisted property videos using automated visual, scripting, and narration models
• Add branding elements such as logos, contact details, and outros/intros

The Service is automated and AI-assisted, and outputs are generated based on user inputs, configurations, and selected workflows.

4. User Responsibilities

You agree that:

• You own or have legal rights to use all images, logos, and materials uploaded
• Uploaded content does not infringe any intellectual property, privacy, or publicity rights
• You will not upload unlawful, misleading, defamatory, or offensive content
• You are responsible for verifying accuracy of generated videos before publishing or distribution

PropVidsAi does not verify property ownership, claims, pricing, or legal compliance of listings shown in videos.

5. AI-Generated Content Disclaimer

You acknowledge and agree that:

• Video scripts, voiceovers, and visuals are generated using AI models
• AI-generated content may contain stylistic, factual, or interpretive inaccuracies
• The Service does not guarantee sales outcomes, lead generation, or marketing performance

PropVidsAi is a content generation tool, not a real estate advisory, valuation, or brokerage service.

5A. User Review and Approval of Generated Content

PropVidsAi provides AI-assisted tools to generate property videos based on user-provided inputs and automated workflows.

Before publishing, distributing, advertising, or otherwise using any generated video, you acknowledge and agree that:

• You are solely responsible for reviewing the generated video in full.
• You determine whether the output meets your quality standards, brand requirements, and intended use.
• Any decision to publish, share, or distribute a generated video is made entirely at your discretion.

Once a video is downloaded, published, or shared by you, PropVidsAi shall not be responsible for any visual, audio, stylistic, or technical characteristics of the output, including clarity, distortion, framing, or overall presentation.

If you choose not to publish a generated video due to quality concerns, PropVidsAi’s obligations are limited to the automated generation of the content as described in the Service, subject to these Terms.

5B. AI Actors and Digital Avatars

All human figures, presenters, actors, or avatars appearing in videos generated through the Service are digitally created using AI-based synthesis models.

You acknowledge and agree that:

• Such AI actors and avatars are not real individuals, and do not represent or depict any actual person.
• Any resemblance to real persons, living or deceased, including likeness, voice, mannerisms, or appearance, is purely coincidental.
• PropVidsAi does not intend to model, replicate, or impersonate any specific individual.

PropVidsAi shall not be liable for any claims, allegations, or disputes arising from perceived resemblance, identity association, or likeness claims related to AI-generated actors or avatars.

5C. AI Systems, Third-Party Services, Downtime, and Manual Fulfilment

PropVidsAi utilises a combination of proprietary in-house technologies, automated workflows, and select third-party services and infrastructure as part of its image processing, video generation, rendering, and delivery systems. You acknowledge that these systems, whether operated by PropVidsAi or by external providers, are complex and may, from time to time, experience scheduled maintenance, capacity limitations, degraded performance, interruptions, errors, or unplanned outages, with or without prior notice.

Accordingly:

• Video generation timelines may be delayed, paused, or in rare cases fail to complete, due to issues affecting any component of the overall processing pipeline, including both internal systems and third-party services.
• PropVidsAi will make reasonable efforts to restore normal processing and/or reprocess the affected project once the underlying issue has been resolved.
• In rare circumstances where automated video generation is materially impacted and cannot be completed through normal system recovery, PropVidsAi may, at its discretion, manually create, rectify, or otherwise fulfil the affected video in order to complete delivery.
• Where such manual fulfilment is required, PropVidsAi will endeavour to deliver the completed video within a maximum lead time of two (2) days from the time you promptly notify our support team of the issue and provide the relevant project details.

Users can contact PropVidsAi as soon as reasonably practicable upon becoming aware of a generation failure, abnormal delay, or incomplete output. Delays in reporting may affect our ability to investigate, reprocess, or manually fulfil the request within the stated timeline.

For the avoidance of doubt, PropVidsAi endeavours to provide a reliable and continuous Service. However, due to the nature of AI-driven systems, automated workflows, infrastructure dependencies, and factors beyond our reasonable control, the Service is provided on an "as is" and "as available" basis as set out in these Terms. Accordingly, uninterrupted availability, error-free operation, or continuous performance of all automated, AI-driven, or supporting systems cannot be guaranteed at all times.

6. Data Usage for Video Creation

To generate videos, PropVidsAi may process:

• Uploaded images
• User-arranged image order
• Contact details provided during video creation (e.g., agent name, phone number, email, branding text)

This data is used solely for:

• Creating intro and outro scenes
• Generating professional narration and overlays

Such data may be processed by AI systems as part of the rendering workflow, as described in the Privacy Policy.

7. Data Retention Policy

PropVidsAi follows a policy-based and best-effort data retention practice.

• Project data, including uploaded images, raw assets, and generated videos, is generally scheduled for deletion typically around three (3) months after the date of creation.
• Users are responsible for downloading and backing up their videos and data within this period.
• Deletion timelines are indicative and not guaranteed, and PropVidsAi does not warrant or guarantee that data will be deleted within a specific timeframe.
• PropVidsAi may retain user data beyond the stated retention period where reasonably necessary for operational continuity, system integrity, backups, dispute resolution, legal compliance, audit purposes, or enforcement of these Terms.
• We are not obligated to provide advance notice prior to any data deletion or retention.

8. Account Information

Information provided during account creation is:

• Stored securely on our servers
• Never shared with AI models except where required for internal account operations
• Disclosed externally only when legally required (e.g., payment gateways, invoicing, regulatory compliance)

9. Intellectual Property

All software, workflows, templates, designs, branding, and underlying technology belong to OneToBeam PTE Ltd.

Users retain ownership of:

• Uploaded images
• Their brand logos
• Final rendered videos

However, PropVidsAi retains the right to use anonymized, aggregated usage data for product improvement.

10. Payments & Refunds

All payments are processed via third-party payment gateways.

Unless otherwise stated:

• Fees are non-refundable once video generation begins
• Failed outputs due to system errors may be reprocessed at our discretion
• Taxes, including GST where applicable, are handled as per local regulations.

11. Limitation of Liability

To the maximum extent permitted by law:

• PropVidsAi is provided “as is” and “as available”
• OneToBeam PTE Ltd and Armonia Technology Services Pvt Ltd shall not be liable for:
  • Loss of business or revenue
  • Marketing outcomes
  • Misuse of generated content
  • Indirect or consequential damages

Total liability, if any, shall not exceed the amount paid by the user for the specific Service.

12. Termination

We reserve the right to suspend or terminate access if:

• These Terms are violated
• Content is unlawful or abusive
• The Service is misused or exploited

Termination does not affect accrued payment obligations.

13. Governing Law

For users in India: governed by the laws of India

Jurisdiction: Courts of Bengaluru, Karnataka

Nothing limits mandatory rights under applicable consumer protection laws.

14. Updates to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance.
